• Service Withdrawal: We reserve the right to withdraw or cancel services, modify product availability, or discontinue items without notice at any time.
• Refunds and Payment: All financial transactions are processed securely through our designated third-party payment processors. Due to the custom, made-to-order nature of 3D printing, all sales are final unless an item arrives structurally broken or defective.

3. Product Characteristics & Customer Expectations

We work hard to ensure our digital listings match physical results, but the nature of additive manufacturing requires managed expectations:

• Inherent 3D Print Variations: You acknowledge that 3D-printed items naturally feature minor cosmetic layer lines, color transitions (especially on multi-color or Silk PLA filaments), or minor surface traits. These are characteristic of the 3D printing process and are not considered manufacturing defects.
• Liability for Errors: We strive for absolute accuracy, but we assume no liability for typographical errors, informational inaccuracies, or pricing mistakes on the Site. We reserve the right to correct any errors and cancel affected orders.
• Website Downtime: We do not guarantee that the Site will be available uninterrupted or error-free. We are not liable for any service interruptions, maintenance downtime, or data transmission errors.

4. Product Safety & Liability Disclaimer

⚠️ WARNING: CHOKING HAZARD – SMALL PARTS
Our primary products include articulated fidget items, movable animals, interlocking dragons, snakes, mystery eggs, and model airplane kit cards.
Age Restriction: Due to moving, interconnected parts and small pieces inherent to model kits, our products are not recommended for children under three (3) years of age.
Assumption of Risk: By purchasing our products, the buyer assumes all responsibility for supervising end-users. NOCO 3D Factory LLC is entirely exempt from liability for any injuries, choking incidents, or damages resulting from product use, misuse, or unsupervised play.
Material Care: Products are printed using high-quality PLA or PETG plastics. These materials can warp or deform under extreme heat. Do not leave items in hot vehicles or direct sunlight.

5. Intellectual Property & Copyright Rules

• Our Branding: The name "NOCO 3D Factory," our industrial gear/mountain logo design, website copy, graphics, and custom media are the sole intellectual property of NOCO 3D Factory LLC and may not be used without written authorization.
• Commercial Printing Rights: We take copyright integrity seriously. NOCO 3D Factory LLC holds authorized commercial printing licenses for every 3D model, dragon, animal, and plane kit card offered for sale on our site.
• Usage Restrictions: Your purchase grants you a physical object. You are strictly forbidden from digitally scanning, replicating, reverse-engineering, or creating digital derivatives of our products for commercial or non-commercial distribution.

6. Rules for User Behavior

To maintain a safe community space, users are strictly forbidden from using our Site, review systems, or contact forms to engage in the following prohibited behaviors:

• Unlawful Behavior: Violating any local, state, federal, or international laws.
• Harmful Conduct: Posting or transmitting hate speech, bullying, harassment, defamation, or abusive behavior toward ownership or other users.
• Spam & Promotion: Utilizing the platform to send unsolicited advertisements, spam, promotional materials, or automated scraping scripts.

7. Account Deactivation

We reserve the right, without notice or liability, to terminate or disable user accounts, refuse service, or block IP addresses from accessing the Site if we determine, in our sole discretion, that a user has violated these Terms, engaged in fraudulent behavior, or abused the platform.

8. Wholesale and Consignment Overrides

If you are a retail shop purchasing inventory under a separate signed Wholesale Purchase Agreement or Consignment Agreement, those specific physical contracts will supersede this document where conflicts occur. However, all retail partners are strictly legally bound to keep our safety and choking hazard labels clearly visible to consumers at the point of retail display.

These Terms and any operational disputes arising out of the use of this website or the purchase of our 3D-printed goods shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
